If you revoke this contract, Frielitz Fahrzeugbau und Zubehör GmbH will pay you all payments received from you, including delivery costs (with the exception of additional costs resulting from you using a different type of delivery than Frielitz's).

§ 5 Termination

1. For contracts without a minimum term, the contractual relationship can be terminated in writing by registered mail for both contracting parties with four weeks' notice to the end of the month.
2. For contracts with a minimum term of two years, the contractual relationship cannot be terminated until the end of the minimum term at the earliest.

§ 6 Invoice and payment

1. You can pay the purchase price for the ordered goods after invoicing by bank transfer or direct debit or by PayPal (only possible online).

§ 7 Retention of title

1. The delivered goods remain until full payment including additional costs, such as any late payment interest, enforcement costs, financing costs and other costs arising from the business relationship.

§ 8 Shipping and assumption of risk

1. If the customer does not specify anything about shipping, Frielitz Fahrzeugbau und Zubehör GmbH chooses the cheapest shipping method (forwarding, postal or parcel service) at its own discretion. Deliveries are made freight collect from the warehouse in D-75391 Gechingen.
2. When the customer sends shipments to Frielitz Fahrzeugbau & Accessoires GmbH, the customer bears the risk associated with the shipment, e.g. the transport risk, until the goods arrive at Frielitz Fahrzeugbau & Accessoires GmbH.
3. The risk for freight-free delivery also passes to the buyer as soon as Frielitz Fahrzeugbau und Zubehör GmbH hands over the goods to be delivered to the customer to the freight forwarder, the freight forwarder, another carrier or another person designated for transport.
4. The goods will only be insured against transport damage if expressly requested and at the expense of the customer.

§ 9 Copyright

1. The catalogs, homepage, e-shops, images and technical drawings are the property of Frielitz Fahrzeugbau und Zubehör GmbH.

§ 10 Other agreements

1. The law of the Federal Republic of Germany applies exclusively to orders and deliveries.
2. The ineffectiveness of individual provisions of these General Terms and Conditions does not affect the effectiveness of the remaining provisions.
3. Place of performance and jurisdiction is, to the extent permitted by law, D-75391 Gechingen.
4. Complaints/Dispute Resolution:
Since February 15, 2016, the EU Commission has provided a platform for online dispute resolution.
In the event of disagreements arising from the contract, Frielitz Fahrzeugbau und Zubehör GmbH is not obliged to take part in an arbitration procedure and cannot offer you participation in such a procedure.

§ 11 The following conditions apply exclusively to entrepreneurs:

1. Frielitz Fahrzeugbau und Zubehör GmbH can accept orders or assignments within 30 days.
2. The order is deemed to have been accepted with the order confirmation, invoice or delivery of the goods.
3. If there are defects in the items delivered, Frielitz Fahrzeugbau und Zubehör GmbH can choose to remedy the defect or deliver a defect-free item within a reasonable period of time instead of withdrawing or reducing the price.
4. If the subsequent performance involves disproportionately high costs for Frielitz Fahrzeugbau & Accessoires GmbH and therefore imposes an unreasonable burden on Frielitz Fahrzeugbau und Zubehör GmbH, it can refuse subsequent performance.
5. Any defect or malfunction of the goods must be reported to Frielitz Fahrzeugbau und Zubehör GmbH immediately in an appropriate form.
All warranty claims expire one year after receipt of the goods.
6. Liability for damages is excluded or limited in accordance with the following paragraphs, provided that fault is involved.
7. In the event of slight negligence on the part of organs, legal representatives, employees or other vicarious agents, the user is not liable unless it concerns liability for injuries to life, body and health.
8. In the event of gross negligence on the part of employees (with the exception of executives) or other vicarious agents, the user is not liable unless it involves a violation of essential contractual points or liability for injuries to life, body and health.
9. Liability for all damages is limited to a maximum amount of €10,000 per case of damage.
